Federal Law
Federal provision 29 U.S. Code 27, which is enforced by the Fair Labor Standards Act (FLSA) and amended by Section 4207 of the Law, requires employers to provide a fair amount of time for an employee to be able to express breast milk, when necessary, for her new born child for a total of 1 year after the child is born. Under federal law, the employer is not obligated to pay the employee for the break time used to for such purpose. Part of this law also requires employers to provide an assured area, besides the restroom, where the employee may be able to express breast milk.
State Law
Employers in Indiana with 25 or more employers are required to provide a private location, other than a restroom stall, where the employee can express breast milk in privacy. Employers are also required to have a cold storage place, like a refrigerator, where the employee could store milk that has been expressed; or allow the employee to bring a personal portable storage device.
