Oregon is one of the seventh states to pass a law removing criminal history inquiries on job applications for private employers through the House Bill 3025. This bill went into effect on January 1, 2016. Oregon’s ban-the-box law, employers are banned from asking an applicant of any criminal history until the initial interview. If no interview is given to the applicant, employer must not inquire applicant’s criminal history until a conditional offer of employment is made.
The House Bill 3025 applies to all Oregon employers, except for those that are required by federal, state, or local law to consider an applicant’s conviction history. The following below must be asked of their criminal history, law enforcement agencies, employers in the criminal justice system, and employers seeking a non-employee volunteer.
