West Virginia has no labor laws on breastfeeding while on break. In fact, West Virginia is the only state that has no labor laws when it comes to breastfeeding on break. Although, there are no laws there are breaks for new parents.
An employer is required to give up to 12 weeks of unpaid family leave time to an employee in the following situations:
- In the occurrence of a birth of a daughter or son
- If an employee has recently adopted
- If a daughter or son, parent, or dependent has a serious health condition, these WV labor laws on breaks apply
If an employer happens to break the law, an employer can face crucial penalties for disobeying a West Virginia labor law for breaks.
