Men will not be getting paid more than woman because of gender. The Equal Work Act allows the state of West Virginia both male and female to be paid the same wage if work is similar. The employer must follow the Equal Work Act and create equal pay for both genders if work requires comparable skills. West Virginia discrimination law prohibits employers from favoring the men with a higher minimum wage.
Other than sex, the equal work act does not apply if wage is made under seniority or based on an excellence system.
Covered employers should not try to get even against an employee for making a complaint about sex discrimination or for instituting or testifying in a related legal proceeding.
