The Delaware Wage Payment and Collection Act requires employers to pay men and women at a fair and equal rate for doing equal amount of labor or the same work-related tasks (DE Code Tit. 19 Sec. 1107A). Under the Act, employers are prohibited to alter the wage of an existing employee to meet compliance, pay an employee at a lower wage rate than what an employee of the opposite sex is making, or discriminate and employee that has taken legal action or filed a complaint about alleged discrimination.
Exception:
The Act does not prohibit an employer from basing an employee’s wage on merit, skill, or seniority.
