Maryland state laws prohibit the use and practice of any forms of lie detector tests in the workplace. Maryland Code Labor and Employment Section 3-702 applies to all employers, businesses and industries in the state. Section 3-702 prohibits employers to require active employees or applicants to participate in a written or oral questionnaire regarding a physical or psychological disability or illness. It is also illegal for an employer to submit an active employee into a lie detector test as a condition for a prospective or continued position of employment.
Violations in The Workplace
Employees and applicants in Maine have the right to pursue legal action against employers that intend to or have violated their rights against lie detector tests. An employee or applicant may:
- submit a written complaint to the Commissioner
- take a case of damages, injunctive relief, or other forms of unlawful relief to court
Unprotected Employment Positions
The provisions listed above do not apply to the following types of employees:
- employees in a State correctional facility that requires the constant contact with inmates
- law enforcement officers
- correctional officers
- communication officers in the Calvert County Center
- employees in a law enforcement agency
