Throughout the U.S there are holidays which are recognized by all such as Labor Day and Memorial Day. Most holidays which are officially recognized by all states, typically pay their employees extra and certain businesses (banks) are closed. States vary in their own state holidays, which reflect the states unique history and culture. Texas has legal holidays that include Confederate Heroes Day, Texas Independence, San Jacinto Day, and Lyndon Baines Johnson Day. Federal labor law, employers are not required to pay employees holiday pay. However, holiday pay is given and required to employees of the federal government and certain government contractors. Closely related, Texas state employees are entitled to a paid day off for federal and state holidays. Smaller business or private employees are not entitled to holiday pay by state law, but can be enforceable if part of an employment agreement.
An employer is not required to offer vacation pay, holiday pay, or pay for hours not worked under the Texas Payday Law. Although, if the employer offers such benefits through a contract agreement, the employer is obligated to comply with the employment agreement. Employer can establish the policy of how paid benefits are earned and when to be used.
